1. Introduction
These Terms and Conditions govern the access to and use of the Stayola platform, including all services, functionalities, applications, subdomains, and content associated with the platform.
By accessing, using, or creating an account on the platform, the user confirms that they have read, understood, and fully accepted these terms.
If the user does not agree with these provisions, the use of the platform must cease immediately.
2. Nature of the Service
Stayola is a digital software platform (SaaS) that allows the publication, management, and promotion of accommodation listings and facilitates direct contact between users.
The platform exclusively provides technological infrastructure for displaying user-generated information and transmitting reservation requests.
Stayola:
- is NOT a travel agency;
- is NOT a hotel operator;
- is NOT a tour operator;
- is NOT a real estate broker;
- is NOT a representative of Hosts or Guests;
- does NOT organize travel packages;
- does NOT contractually intermediate tourism services;
- does NOT carry out tourism intermediation activities within the meaning of applicable legislation;
- does NOT participate in negotiations between users;
- does NOT establish reservation conditions;
- does NOT establish displayed prices;
- does NOT participate in transactions between users;
- does NOT process or manage payments between users;
- does NOT collect money on behalf of users;
- does NOT provide guarantees regarding published services;
- does NOT guarantee reservations;
- does NOT guarantee property availability;
- does NOT guarantee user behavior;
- does NOT guarantee the absolute authenticity of published information;
- does NOT provide tourism services in its own name;
- does NOT provide accommodation services;
- does NOT provide hotel services;
- does NOT have direct control over activities carried out by users outside the platform.
Stayola operates exclusively as a technological platform for listings and communication between users.
The platform exclusively represents a software tool for publishing and managing user-generated content.
3. Role of the Platform
The platform provides:
- technological infrastructure;
- display of user-generated content;
- communication systems between users;
- transmission of reservation requests;
- software functionalities for managing listings and accounts;
- technical functionalities for managing profiles and properties.
Stayola does NOT:
- confirm reservations;
- contractually validate offers;
- exhaustively verify published information;
- guarantee the authenticity of users;
- guarantee the existence of properties;
- guarantee the legality of activities carried out by users;
- guarantee the fulfillment of obligations assumed between users;
- guarantee the accuracy, completeness, or updating of published information;
- guarantee the quality of services offered by users;
- guarantee compliance of properties with applicable legal requirements;
- guarantee the authorization of activities carried out by users.
All information published on the platform is provided directly by users and is exclusively assumed by them.
Stayola has no legal or contractual obligation to proactively verify all information published on the platform.
4. Contractual Relationship
Any agreement regarding accommodation, payment, access to property, or reservation conditions is established directly between the Host and the Guest.
The accommodation service contract is concluded exclusively between users.
Stayola:
- is NOT a party to the contract;
- does NOT represent users;
- does NOT act as an agent or proxy;
- does NOT act as a commercial intermediary;
- does NOT assume contractual obligations toward users;
- is NOT responsible for the execution or non-execution of services;
- does NOT guarantee compliance with obligations assumed between users;
- is NOT responsible for the behavior of Hosts or Guests;
- is NOT responsible for the legality of activities carried out by users;
- is NOT responsible for damages resulting from relationships between users.
Any dispute, misunderstanding, or complaint regarding accommodation services must be resolved directly between users.
5. Accounts and Access
Account creation requires the use of a valid email address and the provision of real and updated information.
Users are solely responsible for:
- the information provided;
- activities carried out through their account;
- the security of authentication credentials;
- using the platform in compliance with the law;
- all actions performed through their account.
The following are prohibited:
- the use of false identities;
- the use of another person’s data without authorization;
- creating multiple accounts for fraudulent purposes;
- using the platform for illegal purposes;
- using automated systems without the platform’s consent.
Stayola may:
- request additional verification;
- temporarily suspend accounts;
- restrict access;
- delete suspicious accounts;
- refuse access to the platform without prior notice;
- investigate activities considered suspicious;
- cooperate with competent authorities in accordance with legal obligations.
6. Verification System
Properties and users may have statuses such as:
- unverified;
- partially verified;
- verified;
- other internal classifications.
Verification may include:
- email confirmation;
- phone confirmation;
- supporting documents;
- photo/video materials;
- proof of property usage rights;
- identification documents;
- documents regarding carried out activities;
- other information considered relevant.
Verification is exclusively informational and indicative.
Verification status:
- does NOT represent a legal guarantee;
- does NOT represent a contractual guarantee;
- does NOT represent official certification;
- does NOT guarantee absolute authenticity;
- does NOT guarantee transaction security;
- does NOT guarantee the legality of users’ activities;
- does NOT imply assumption of liability by Stayola.
7. Listings and Content
The Host is solely responsible for:
- the accuracy of published information;
- the legality of the activity carried out;
- the existence of the right to use the property;
- compliance with applicable legislation;
- obtaining necessary authorizations;
- declaring guests in accordance with legal obligations;
- establishing accommodation conditions;
- the direct relationship with guests.
Users may not publish:
- false information;
- illegal content;
- misleading materials;
- abusive content;
- offensive content;
- materials infringing third-party rights;
- discriminatory content;
- content violating applicable legislation.
Stayola may remove, modify, restrict, or suspend any content considered non-compliant without prior notice.
8. Reservations
A reservation represents exclusively a request transmitted to the Host through the platform.
Reservation confirmation belongs exclusively to the Host.
Stayola does NOT guarantee:
- reservation acceptance;
- reservation completion;
- property availability;
- the accuracy of published information;
- fulfillment of obligations between users;
- users appearing at the location;
- compliance with conditions established between users.
9. Payments
All payments are made directly between users.
Stayola:
- does NOT process payments;
- does NOT manage transactions;
- does NOT collect transaction commissions;
- does NOT hold users’ funds;
- does NOT provide financial services;
- does NOT act as a payment processor;
- does NOT guarantee transactions;
- does NOT provide financial protection;
- is NOT responsible for fraud, refunds, or financial disputes.
Users fully assume responsibility for transactions carried out.
10. Reviews and Reputation
The platform may allow reviews for Hosts and Guests.
Stayola may moderate, restrict, or remove content considered:
- false;
- manipulative;
- offensive;
- illegal;
- abusive;
- suspicious;
- misleading.
Reviews and reputation systems are exclusively informational.
11. Trust System
Stayola may grant badges or classifications such as:
- Verified Host;
- Trusted Guest;
- Super Host;
- other internal classifications.
These are informational only and do NOT represent:
- legal guarantees;
- contractual guarantees;
- official certifications;
- confirmations regarding user safety;
- confirmations regarding the legality of activities carried out.
12. User Obligations
The Host:
- complies with applicable legislation;
- declares guests according to legal obligations;
- establishes their own accommodation conditions;
- assumes full responsibility for carried out activities;
- is responsible for published information.
The Guest:
- uses the platform in good faith;
- complies with conditions established by the Host;
- complies with applicable legislation;
- assumes responsibility for their own behavior.
Users may not:
- use the platform for illegal purposes;
- engage in fraudulent activities;
- collect data without authorization;
- copy the platform;
- use automated data extraction systems;
- affect the functioning of the platform;
- introduce malware or malicious code.
13. Intellectual Property and Copying Prohibition
The entire Stayola platform, including:
- the Stayola name;
- logo;
- design;
- platform structure;
- functionalities;
- verification systems;
- texts;
- graphic elements;
- databases;
- source code;
- object code;
- interface;
- visual concepts;
- commercial structure;
- proprietary content;
- materials published by the platform;
- software architecture;
- informational structure;
- internal systems;
- algorithms;
- functional structure
are protected by national and international legislation regarding:
- copyright;
- trademarks;
- unfair competition;
- intellectual property;
- database protection;
- applicable digital legislation.
Without prior written authorization from Stayola, the following are strictly prohibited:
- copying;
- reproduction;
- cloning;
- translation;
- distribution;
- republication;
- content reuse;
- scraping;
- database extraction;
- reverse engineering;
- copying functionalities;
- copying platform structure;
- automated use of data;
- imitation of the platform’s commercial or visual concept;
- development of similar platforms using Stayola’s content or structure.
Any unauthorized use may result in:
- suspension of access;
- deletion of accounts;
- claims for damages;
- civil liability;
- administrative liability;
- criminal liability under applicable legislation.
14. Limitation of Liability
To the maximum extent permitted by law, Stayola is NOT liable for:
- financial losses;
- indirect losses;
- loss of profit;
- misunderstandings between users;
- cancellations;
- no-shows;
- fraud;
- attempted fraud;
- false information;
- user behavior;
- quality of services;
- fulfillment of obligations between users;
- disputes between users;
- platform unavailability;
- technical errors;
- data loss;
- cyberattacks;
- temporary service interruptions;
- problems resulting from platform use.
The platform is provided “as is” and “as available,” without express or implied warranties.
15. Control and Sanctions
Stayola may:
- suspend accounts;
- delete listings;
- restrict access;
- remove content;
- block users;
- investigate suspicious activities;
- cooperate with competent authorities.
These measures may be applied without prior notice.
16. Personal Data
Stayola collects and uses personal data strictly for platform operation, in accordance with applicable data protection legislation, including GDPR.
By using the platform, users accept the processing of data according to the Privacy Policy.
17. Applicable Law and Jurisdiction
To the extent permitted by applicable law, these Terms and Conditions are governed by and interpreted in accordance with the laws of Romania.
Any dispute, claim, or controversy arising out of or related to the use of the Stayola platform shall fall under the jurisdiction of the competent courts of Romania, except where applicable law provides otherwise.
By using the platform, users accept the jurisdiction of Romanian courts.
18. Final Provisions
The invalidity of any provision of these Terms shall not affect the validity of the remaining provisions.
Failure by Stayola to exercise a right shall not constitute a waiver of that right.
Users confirm that they have read, understood, and fully accepted these Terms and Conditions by using the platform.

Stayola is exclusively a software platform for listings and communication between users and does not guarantee reservations, transactions, user behavior, or the fulfillment of obligations between users.
